1. USE OF OUR SERVICES

Sure jobs is an online service marketplace where individuals and enterprises can either buy or sell services, as well as post and participate in volunteer projects. The Platform integrates professional social networking with freelance services and job placements in various categories.

Access to our Platform is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide without notice. We will not, and neither will any of our partners, be liable if for any reason our Services are unavailable at any time or for any period. We may make some parts of our Services available only to Users who have registered an account with us. You may be required to register an account with us and submit certain personal data to access certain parts of our Services.

You must be eighteen (18) years or over in order to use the Platform and its services. Sure Jobs does not knowingly collect, either online or offline, personal information from persons under the age of 13.

2. REGISTRATION, ACCOUNT AND COMMUNICATION PREFERENCES

In order to access and use certain areas or features of the Services, including requesting services from Providers or providing services as a Provider through the marketplace, you will need to create an account.

An “Individual Account” is created when a person registers for an account at Sure Jobs to provide freelance services, seek job placements and engage in the community. A “Company Account” may be created by the representative(s) of an entity looking to use the services to seek candidates and/or engage in freelancer services. Individuals and companies can place/order freelance services. Each engagement entered into through the Services shall be referred to as a “Project”. Both individual and company accounts are subject to the conditions relating to accounts as outlined in the Terms.

By creating an account, you agree to

(i) provide accurate, current and complete information about yourself as necessary,

(ii) maintain and promptly update from time to time as necessary your account information,

(iii) maintain the security of your password and accept all risks of unauthorized access to your account and the information you provide to us, and

(iv) immediately notify us if you discover or otherwise suspect any security breaches related to your account. In creating an account, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or any other applicable jurisdiction. We reserve the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, false or misleading.

1. Membership plans and Promotional packages. All accounts have basic free features which can be augmented with the purchase of membership plans or recruitment promotional services.
2. Communication Preferences. By creating an Account, you also consent to receive electronic communications from Us (e.g., via email or by posting notices to the Platform). These communications may include notices about your Account (e.g., password changes, updates and other transactional information) and are part of your relationship with Us. You agree that any notices, agreements, disclosures or other communications that we send to you electronically will satisfy any legal communication requirements, including, but not limited to, that such communications be in writing.
3. Account Information; Updates. You agree to provide current, complete and accurate payment and account information for your Account. You promise to update the information you have provided to Sure Jobs in the event of any changes to your contact information, or background. Specifically, with respect to your contact information, Sure Jobs may deliver notices to you at the most recent email, telephone, or address provided by you, and those notices will be considered valid even if you no longer maintain the email account, telephone number, or receive mail at that address unless you provide updated contact information to us.
4. Account Access and Security. Also, you are, and will be solely responsible for, all of the activity that occurs through your Account, so please keep your password and Sure Jobs Account information secure. You agree that you will not disclose your password to any third-party and that you will take sole responsibility for any activities or actions under your Sure Jobs Account, whether or not you have authorized such activities or actions. You will immediately notify Sure Jobs of any actual or suspected unauthorized use of your Sure Jobs Account. We are not responsible for your failure to comply with this clause, or for any delay in shutting down or protecting your Sure Jobs Account after you have reported unauthorized access to us. We reserve the right to suspend the provision of the Services or any part thereof, if any information provided during the registration process or thereafter proves to be inaccurate, false, or misleading. You are responsible for all charges incurred under your Account, whether made by you or another person using your Account. You may not assign or otherwise transfer your Account to any other person or entity. You acknowledge that we are not responsible for third party access to your account that results from theft or misappropriation of your account. We reserve the right to refuse or cancel service, terminate accounts, or remove or edit content from the Platform if in our opinion, you have failed to comply with any of the provisions of these Terms.

3. ACCESS TO THE SERVICES

We shall use commercially reasonable efforts to ensure the availability of the Services, except that we shall not be liable for: (a) scheduled downtime; or (b) any unavailability caused directly or indirectly by circumstances beyond our reasonable control, including without limitation, (i) a force majeure event; (ii) Internet Host, webhosting, cloud computing platform, or public telecommunications network failures or delays, or denial of service attacks; (iii) a fault or failure of your computer systems or networks; or (iv) any breach by of these Terms by you.

4. CONTRACTUAL RELATIONSHIP BETWEEN USERS

On the Platform, Users may post job listings as to open positions for employment or freelance work. Sure Jobs does not vet or verify any of the of job listings posted by businesses or the candidates who respond to such listings or the accuracy of the information provided by such candidates.

Sure Jobs merely makes the Services available to enable Users to find and transact directly with each other. Sure Jobs does not introduce candidates, find freelance projects, or find employees for its Users. Users are responsible for evaluating and determining the suitability of any projects, freelancers, and candidates on their own. If you decide to enter into agreement with another User of Sure Jobs, such an agreement is directly between the Users and Sure Jobs is not a party to that agreement.

You acknowledge, agree, and understand that Sure Jobs is not a party to the relationship or any dealings between you and another User. Without limitation, Users are solely responsible for: (a) ensuring the accuracy and legality of any User Content; (b) determining the suitability of other Users prior to entering into an agreement (such as any interviews, vetting, background checks, or similar actions); (c) negotiating, agreeing to, and executing any terms or conditions of any agreements; (d) performing services; or (e) paying for services. You further acknowledge, agree, and understand that you are solely responsible for assessing whether to enter into an agreement with another User and for verifying any information about another User. We do not make any representations about or guarantee the truth or accuracy of any Users listings or other User Content listed on the Services; do not verify any feedback or information provided by Users; and do not vet Users; or perform background checks on Users listed on the Services. You acknowledge, agree, and understand that RemoteHub does not, in any way, supervise, direct, control, or evaluate Users or Users’ work and is not responsible for any project, services or work product. RemoteHub makes no representations about and does not guarantee, and you agree not to hold RemoteHub responsible for, the quality, safety, or legality of services provided by a listed User; the qualifications, background, or identities of Users; the ability of a User to deliver services; or the ability of User to pay for services provided; User Content and statements or posts made by Users.

Sure Jobs IS NOT A RECRUITMENT AGENCY, STAFFING AGENCY OR EMPLOYMENT AGENCY. YOU ACKNOWLEDGE THAT ANY RELIANCE ON MATERIAL POSTED BY OTHER USERS WILL BE AT YOUR OWN RISK. ANY CONTRACTUAL AGREEMENT YOU ENTERED INTO WITH A THIRD PARTY WILL NOT BIND REMOTEHUB IN ANY WAY AND REMOTEHUB SHALL NOT BE CONSIDERED A PARTY OR A THIRD-PARTY BENEFICIARY OF SUCH AGREEMENT.

5. WORKER CLASSIFICATION

User is solely responsible for and has complete discretion with regard to selection of any other Users in the platform for employment or Freelance Services. User acknowledges and agrees to follow appropriate classification for employees and independent contractors as may be required by a applicable law and assumes all liability for determining whether an individual is engaged as an independent contractor or as an employee. Users are solely responsible for any and all taxes, estimated taxes, withholding, Social Security contributions or payments, disability insurance, workers’ compensation insurance, unemployment taxes, other payroll type taxes and employment reporting applicable to any User hired or engaged through the Services (collectively, “Taxes”). You hereby indemnify and hold Sure Jobs harmless from, any claims, losses, costs, fees, liabilities, damages or injuries suffered by Sure Jobs arising out of the failure with respect to its obligations and/or payment of any Taxes due under applicable law. This section shall survive the termination of this Agreement.
